Appellant was found guilty of possessing a deadly weapon in a penal institution and sentenced to 25 years of incarceration by the Texas Department of Criminal Justice – Institutional Division (“TDCJ-ID”). He appeals both his conviction and punishment; we hold that his conviction and punishment were improper, due to court below failing to allow defense arguments regarding necessity for his actions, thus we affirm.
